Sir,
My name is Dayanand Jayant Nene and I am a member of the Saket Managing Committee. Earlier I was Chairman of the Society till April 2016.
I had twice written to the TMC on the above subject but got no response.
Then, a few days ago, I came across a news item wherein the State Information Commissioner had directed the BMC to reconstruct files of all old buildings which are missing. ( I am attaching the news item for your perusal).
That item has given me a glimmer of hope and i am writing to you again with the confidence that you will help us out.
I will brief you about our case.
Saket is a township of 24 buildings and 3 Towers.
We, members of Saket CHS Ltd, have many times in the past

years, have individually and also collectively - through the Society Managing Committee, requested the Thane Municipal Corporation to provide us with approved plans of Saket Complex so that we could apply for the Occupation Certificate.
We were compelled to approach the Corporation as our Developer M/s Wescon Properties Pvt Ltd had not given us any papers pertaining to the plans of the complex.
We have also asked information about the Complex thru RTI's lodged with
the TMC
on different occasions.
All along we have been receiving an answer from the TMC that all files pertaining to Saket Complex have been taken away by the Anti Corruption Bureau, way back in 1996 and that the TMC does not have any papers pertaining to Saket.
I have a email of our ex Commissioner R A Rajeev wherein he has also mentioned that TMC does not have the approved plans of Saket Complex.
Strange as the answer sounds, we always believed in the TMC version and waited hoping that once the case is decided upon, we can get our requisite papers and apply for the OC.
However, as the case dragged on for over almost 2 decades, we started getting restless and approached the Anti Corruption Bureau in Thane and thru them the Thane Court and applied for attested True Copies of papers of the Complex.
We were told by the ACB that the case of Saket bore number 1/96 and the charge sheet was filed thru special case no. 15/2000.
The Court and ACB were kind enough to allow us to search their godowns under supervision of an official.
We searched for our file on 3 different occasions for over 6 hours but could not locate the file.
Sir, considering that Saket's was a high profile case at that time, we are afraid that Saket's file may have gone "missing" - for obvious reasons.

ast year we have applied for the OC under the Amnesty Scheme of the Corporation but there has been no movement on the same even though a year has elapsed. On making queries, we are told by the Town Planning Officials - the same answer - Saket Approved layout and other papers are not available.
In view of all the above facts, we request you to invoke sections of the Maharashtra Public Records Act and reconstruct Saket's File.
No file is independent and is a part of a string of documents and can be reconstructed.
A similar exercise was undertaken by the State Govt when several files were destroyed in the Mantralaya fire
a few years ago.
Sir, there are 850 residents and families residing in 24 buildings and 3 Towers of the Saket Complex.
For no fault of ours we are unable to get our Occupation Certificate and Conveyance - even though we have bee

waiting
for the same since past 10-15 years.
We request you to consider this appeal with the seriousness it deserves and help us in the matter.
