Draft minutes of adjourned AGM.

Dear Sir,
I refer to the draft minutes of the AGM sent by you to me  along with the CD of the proceedings.
On going through the CD my observations are:
1) First of all, Pradeep Gupta had no business to address the meeting and talk on behalf of the Managing Committee.

2) Was he authorized by the Managing Committee to do so, if yes then in which meeting and whether is it minuted ? According to my knowledge - no.

3) What Pradeep Gupta had said there is a whole lot of bulshit and half truths. He was criticizing the Managing Committee,  baselessly levelling false allegations and should have been stopped by the Chair, instead all seemed to be enjoying the scenario.

4) At one point of time when he asked Mr. Abhyankar a question and Mr Abhyankar sarcastically refused to answer him, it was shocking to see members of the Dias and off it actually clapping??

5) As informed to you earlier, I am going to reply and rebutt all his allegations and half truths vide emails to all Saketians. 

I shall systematically expose his mistakes and how our Office bearers blindly sign the most important documents of the society - its Balance Sheet and Income and Expenditure Account - without understanding ABC of it.

6) I shall also expose how members who dare to question are bullied in to submission.

In the meanwhile, I request you to expunge everything said by Pradeep Gupta from the Draft minutes of the AGM.

2] Dear Saketians,

When our Managing committee took charge in 2015, the MCS Act 1960 as well as the byelaws were amended and the one major change which happened was in case of Associate Membership.
Earlier, a person could fill in a Associate Membership form, pay Rs. 100/- and become a Associate Member.
This was done away in 2014 and and Associate Member was thus defined:

Associate Member of a society:
The Amended Act states that the Associate Member is the person who has a direct financial interest in the property but whose name does not appear 1st on the Share Certificate.
Only such person - with the written consent of the person whose name appears 1st in the Share Certificate, can contest society election, be part of the Managing Committee or attend General body meetings.
The old method of registering Associate Members by paying Rs. 100/- has been done away.

Accordingly, when we assumed charge in 2015, after due discussions with the Dy. Registrar, we enforced the rule in Saket.
However, last year, before reconvening the adjourned AGM, the then Office bearers we misled by by their new Poster boy and they also, without discussing the matter in the Managing Committee, arbitrarily allowed some non eligible members in the meeting.
These members then made uncharitable remarks against me - which is there on the CD.

In the trailing mail, I am detailing the advise given by me to a 68 year old society in Mahim on the same issue.

Following is the position of an Associate Member.


Associate Member of a society:

We have noticed that many co-operative housing societies have either elected or co-opted Associate Members (by paying Rs.100/- as Associate Membership fee) on the managing committees. 

If you have any Associate Member as MC Member in your co-operative housing society, LODGE a formal complaint with Deputy Registrar / Assistant Registrar of your concerned ward immediately with the following reference and ask such MC Member to resign or get him / her dismissed.

◾Even though there is not mentioned the name as an owner in the purchase deed, the Associate  Membership can get by paying only admission fee and with the consent of the original member.In the absence of original member and with his consent associate member can attend the annual general body meeting, the associate member can take part in the election as a voter/ candidate. In case the associate member gets elected as a committee member, he becomes office bearer also.

A person, who became an Associate member by paying only admission fee, shall not get any rights in voting or election behalf the original member. It is necessary for the Associate member that his share/name is included in the ownership of property for holding share jointly.”

3] Dear Saketians,

1) When we took charge of the society management last year, Mr. Jaywant handed over the Cash box to us which contained Rs. 1281/-. The same was recorded in the Cash Book as on March 31, 2015 and was signed by Mr. Jaywant.

2) Later, the accounts for that year were audited and the then auditor Mr. Sanjay Tupe after verifying all the records had certifed the Cash in Hand as Rs. 1281 in the Balance Sheet - and the same was duly signed by the Auditor and our Office bearers last year before the AGM.

3) Since Mr. Tupe was not on the Govt panel, it was decided to get the accounts audited again from a empanelled auditor.

4) Here in entered Mr. Pradeep Gupta - the new Poster boy of the then Office bearers. He got the accounts audited again and to the shock of many- he showed the Cash in Hand as Rs. 35,923/- - when actually the Cash received from Mr. Jaywant (Old Committee) was only Rs. 1281/.

5) For the year ended March 31, 2016, after depositing excess cash in the bank, I signed the Cash book which showed Rs. 3371/-. 

6) However, the Balance Sheet shows that there was a Cash in Hand of Rs. 37,631/- as on March 31, 2016 - which actually was never there.

7) Most disgustingly, the society office bearers have blindly signed these Balance Sheets - thereby accepting that there was that much Cash in the Cash Box as of that date.

8) The implication of this is that tomorrow if any member through a letter of RTI seeks information of Cash in Hand - the society will have to give that figure which is signed by the Office bearers - and actually that Cash will not be there in the society - so a natural question is - where has that Rs. 35,000/- gone and who should reimburse it to society ?
- Obviously the people who have signed the Balance sheet and accepted that that much Cash was there. 

9) The strange thing is that the Poster boy was part of the Managing committee for the period 2009 - 15.

10) It will be interesting to watch what the Auditor will show as Opening balance while auditing the accounts for the Financial year 2016-17. 

THAT IS WHY I SAY THAT INSTEAD OF CORRECTING OUR ACCOUNTS THE POSTER BOY HAS TOTALLY MESSED THEM UP. HE HAS EVEN BROUGHT IN AMOUNTS THAT WERE WRITTEN OFF BY PREVIOUS AGM'S - MORE ABOUT THAT IN MY FUTURE EMAILS.
AND OUR OFFICE BEARERS HAVE BLINDLY SIGNED THE ACCOUNTS WITHOUT UNDERSTANDING THEM AND A MOTLEY CROWD OF 40 ODD MEMBERS OUT OF 672 HAVE ADOPTED THEM IN THE AGM. 

AND PEOPLE WHO DONT UNDERSTAND ABC OF ACCOUNTS ARE TALKING OF DOING REPAIR AND RENOVATION PROGRAMS WORTH CRORES - GOD SAVE THE SOCIETY.

SAKETIANS - PLEASE AWAKE FROM YOUR SLUMBER..
