Preamble

This charter is an addendum to the bye laws adopted by Saket Cooperative Housing Society Limited (Registration No. TNA/ (TNA)/HSG./TC/10585/99 dated 9-99).
It lays down the rules which have been agreed by the co-operative society and is binding on all members of the society.
Any issue in interpretation of the rule is to be referred to the Managing Committee members and they will clarify the society’s stand accordingly. These rules are not meant to curtail the rights of the members. The objective of this Code of Conduct is for members to have a common understanding of the society’s norms and to avoid disputes arising between members and the Society. 

All the members are shareholders and hence owners of the society.  It is up to them to ensure that its security, amenities, hygiene and upkeep are kept at a high standard.  The Society Rules have been framed to help us to collectively achieve the objective of making this a revered address in Thane.
Even though the members have bestowed the responsibility for day to day management on the Managing Committee, all members have to ensure that these rules are adhered to by all residents – their family members, guests, servants and tenant/licensees etc.

Being responsible members of the society, it is for us to discharge our obligations towards the community by conserving water, electricity, consuming less and ensuring recycling of natural resources.

  1.   Instructions to Security Guards - Members/residents are solicited to cooperate in execution of these instructions by the security guards -

a.    The security guards shall not leave their posts under any circumstances.
b.    To ensure that proper details of visitors are properly entered in Visitors Register before permitting entry;

c.     Not to allow any unauthorized person to enter the guard room;

d.    Not to undertake/perform personal work of anyone while on duty;

e.     Not to smoke/chew pan, etc. or read newspapers while on duty;

f.     Not to accept keys or belongings of any flats from the Members/residents. If they do so, it will be deemed to be dereliction of duties;

g.    Not to allow entry/exit of vehicles or outside personnel carrying house-hold goods without gate pass / prior approval;

h.     Not to allow service providers to loiter unnecessarily within the Society premises;

i.      To keep a watch on children and not allow them to exit Society premises without adult escort;

j.       To take frequent rounds to ensure safety of Society’s properties and of vehicles;

k.      To attend to lift/fire alarm calls from lifts and take action thereafter;

m.   To check the bags or belongings of domestic help/service providers.

n.     To ensure that workmen entering the building for repair work in flats stop work at the stipulated time and leave the building.

o.    These instructions are not exhaustive and detailed rules are available with the Security Supervisor.

2.         Parking of Vehicles in the Society Premises                

a. Members/residents should submit an application, in a form available in the Society office, for issuance of parking label. The number of parking stickers will be limited to the number of parking lots owned by the members. The sticker will have the vehicle registration number and should be pasted on the vehicle.

b.    If any vehicle is found to be parked in the slot of another Member/resident, or improperly parked, thus causing avoidable inconvenience to others, it will be considered to be a violation by the Society Rules. The vehicle will be immediately towed away and a fine of Rs. 500 per day will be levied on the defaulting member till the vehicle is parked in its proper place.

c.     Vehicles cannot be parked in areas other than the designated parking areas.

d.    Vehicles of visitors should be parked in the earmarked visitor parking slots.

e.     Overnight parking for visitor’s vehicles will not be allowed in the building compound without prior permission from the society’s office, which may include charges as specified.

f.    No honking is permitted within the premises. The speed limit within the premises is 5 kmph.

3.         Maintenance of garden and lawn: a.     Playing ball games like cricket, football, hockey is allowed in the designated areas only. Parents need to ensure that children are educated about :

o    shoes with studs are not allowed for playing football

o    markings or cricket stumps/permanent goal posts are not allowed

o    season ball should not be used while playing cricket

b.    Sleeping/lying down on the lawn, either during day time or at night, cycling or dog walking on the lawn [except the designated area for pets] is not permitted.

4.         Horticulture                

a.     Please do not throw waste from the flat into flower pots etc. Bringing eatables / having a picnic on the lawns is prohibited

b.    Please do not (and also educate children not to) pluck leaves & flowers or damage any plant;

c.     Please discourage any activity that damages the Hyde Park, Badminton Court area, Walkathon area in any manner.

  5.         Repairs, renovation or alteration in flat: a.     Members/residents shall not carry out any repairs, renovation or alteration in his/her flat without obtaining prior written permission of the Managing Committee except in the case of minor repairs (as specified in Annexure 1).  The repair work must not cause any inconvenience to flats occupied by other members / residents;

The Society reserves the right to refuse permission for changes which in their opinion will damage / alter / irreparably harm the structure / façade of the building

b.    A  Member should make an application for obtaining permission from the society at least 15 days before work is scheduled to commence by furnishing full details of the repairs, alteration etc. enclosing a sketch of the flat showing therein the alteration proposed, certification from certified structural consultant confirming that such changes do not weaken or alter any original structural members, and the name of the contractor to whom the work is to be entrusted.

c.     All the costs incurred by the Society in verification of plans, inspection of changes and approvals, if any,  will be borne by the member

d.    In case of rented flat, such application must come from the owner of the flat and not from the occupant; and that too atleast 15 days prior to commencement of the Rent. Also, the Police information form ( attached herewith) should be duly filled and submitted to society before the tenant moves in.

e.     If the Managing Committee decides to grant permission, it shall be subject to the following conditions:

i)      R.C.C. beams and columns should not be damaged or modified under any circumstances;

ii)     Walls, ceiling or any other parts of the adjoining flat should not be damaged;

iii)    The work shall be carried out only during the permitted hours, viz. from 9.00 a.m. to 2.00 p.m. and 4.00 p.m. to 7.00 p.m.  No work will be allowed on Sundays and Public Holidays. Workers will not be allowed to remain in the building beyond the time of work closure

iv)    The member shall be required to deposit interest free refundable deposit with the Society (as described below) as security against any damage which may be caused to the property of the society or of any other member in the course of the work:

I.      Civil work (changes in flooring/ walls/ceiling/plumbing) of entire flat (all rooms)  along with painting, woodwork or electrical  work:

o    For 1 BHK flat Rs. 20,000/-

o    For 2 – 3 BHK flats / villas Rs. 50,000/-

II.     Civil work (changes in flooring/ walls/ceiling/plumbing) of individual rooms along with painting , woodwork or electrical  work : Rs. 5,000 per room (for any bedroom, kitchen, bathroom or hall)

v)     Once approval is given by the Society and deposit paid, the  Property Manager shall be authorized to make a daily round to the flats to ensure that the work is being done as per the approval given. The society shall levy a non-refundable charge from the day of commencement of work of Rs. 1,000 per fortnight (or part thereof) per flat for work inside the flat as a charge to cover the cost of inspection and use of lifts.

vi)    In addition to the above deposit, the member will have to furnish a duly signed indemnity in the form specified in Annexure 2 at the time of applying for permission.

vii)   After the repair work is completed, the deposit will be refunded within 15 days, after deducting the cost of damages if any. In case the cost of damage exceeds the deposit amount, the extra cost shall be recovered from the member within 7 days

viii)  Rubble / waste material should be accumulated in the flat (not lobby) and disposed directly outside the Saket premises.

ix)    Input material for the approved repairs/changes must be stored in the member’s flat and not anywhere else

x)     The Society reserves the right to specify the quality of the construction material in the larger interest of the members/building

xi)    It shall be the responsibility of the members to obtain necessary permission from the Municipal Authorities as may be required from time to time and members shall have to provide an undertaking to the effect that necessary approvals from relevant authorities have been obtained and such changes / modifications are in compliance with law.

xii)   The Managing Committee is at liberty to impose such other relevant conditions as may be required from time to time;

6.         Use of terrace areas : a)    Terrace areas are meant to be used only in case of emergencies. Members / residents are not permitted to use the terrace areas for any other purpose.

b.    Any occupation and / or encroachment and / or un-authorized use of terraces including use  for holding parties/get together or for storage is a serious safety violation. In such cases the society is entitled to levy stringent penalty at its sole discretion, which will be without prejudice to immediate removal/stoppage of encroachment/unauthorized use through the security staff

c.     The doors to the terraces should remain locked at all times. Keeping them open is strictly prohibited.

7.         Throwing of garbage, rubbish etc. through the windows / buildings: a.     Always throw waste only in the garbage bins within individual homes or designated garbage bins in common areas within Saket  premises.

b.    Garbage should be disposed in accordance with the rules specified by the Society from time to time

c.     Do not throw liquid waste like sabji, dal, sambhar, etc. directly into the garbage bins because this leads to breeding of mosquitoes/insects

d.    Members should not feed birds (pigeons etc.) from their window sills & dry balconies and in the common area, lawns etc. as this leads to birds flocking around the building and dropping their waste in balconies  and water bodies.

e.     Always put your garbage in a garbage disposal bag before dumping it into the garbage bins. The garbage bags should be tied up before disposal. This is not only hygienic but also ensures safety of the staff member who removes garbage;

f.     Violation, if found, will be considered to be a serious breach by the Society and appropriate penalty will be imposed;

.         Use of Lifts              

a.     Lifts should be used properly and maintained in a good condition. Press the buttons gently while operating the lifts. Do not (and also educate children not to) write/scratch/damage on the walls of the lift;

b.     Avoid travel of children alone in lifts, since they cannot react to emergency situations, in case they get stuck;

c.    Educate children about the right usage of lifts and not to press Emergency Call button for pleasure / fun.

d.     Educate children not to play around with lift switches and doors, which could lead to accidents;

e.     Do not overload the lift beyond its capacity

f.    Furniture and other heavy loads are not permitted in the lift. Use of lifts for shifting of luggage / furniture will entail a charge of Rs. 1000 per relocation. Any damage incurred during shifting will be recovered from the member. However moving one or two articles will not attract this charge. In the event of relocation, luggage/articles should be shifted at specified timings only.

g.     Spitting in the lifts is strictly prohibited. If any Member/tenant/their children/their visitor is found to spit/spoil the lift or break the switches or damage the lift, it will be considered to be a serious violation by the Society;

h.      Do not panic in case you get stuck in the lift for any reason whatsoever. Security Guards & elevator assistance service personnel will rush to your assistance.

9.         Misuse of Common Areas, lobbies and stair cases: a.   Please ensure that no servant is allowed to sleep either during day time or at night in lobbies, landings, foyers of the buildings or water tanks, or to make any kind of nuisance in these places;

b.  Members should ensure that for safety purposes, the staircase should, at all times, be free of any encumbrances

c.   Do not misuse or damage common facilities and amenities and instruct your domestic help and visitors accordingly;

e.     Security staff has been empowered to enforce this rule strictly and to physically remove such material or luggage etc. from these places.

f.     Members/residents are advised strictly not to encroach upon the common areas of the Society. Such encroachment will be viewed seriously and the Managing Committee will take all steps for eviction of the same in addition to levy of penalty to be decided by it;

g.    Members/residents are strictly prohibited from smoking/ drinking in the common area of the Society or do any such act(s) which are obscene, unsocial or uncivilized. The Managing Committee will view violation of this instruction very seriously and will initiate stringent action, such as complaining to Police authorities and getting the erring person evicted.

h.     Smoking is totally prohibited in the common areas of the building premises.

10.    Club House Rules a.   Use of club house is restricted to authorized members of the society and those residing as tenants/lessees with prior approval from the society.

b.   This facility can be availed of only during prescribed hours as decided by the society from time to time;

c.   Flat owners and their family members residing with them in the flat can only use these facilities on producing of ID card issued for the purpose.

d.   Bins provided in each facility area should be used instead of littering the common area.

11.        Rules while letting out flats on rent / vacating of flats by tenants                

a.   No flat, parking slot  or a part thereof, can be given on lease or leave and license (L&L) agreement without prior permission in writing of the Managing Committee of the society, after compliance with such requirements as the Managing Committee may require time to time;

b.    No member is permitted to use / sublet / lease the flat premises for any Guest House and / or any commercial purpose at any point of time;

c.     A Member wishing to give his /her flat on leave & license (L&L) should submit an application to the Society in the specified format (refer Annexure 3). A copy of the L&L agreement should also be submitted for approval;

d.    The member will be required to pay non-occupancy charges / as per the Society rules for leave and license / subletting of flats. In case the flat is let out during the course of a month, such charges will be applicable for the full month.

e.     Members should give prior intimation in writing about details of the tenant, date and time of shifting, so that security can facilitate the entry of their luggage/ vehicle and record it in the register. Use of lifts for shifting of luggage / furniture will entail a charge of Rs. 1000 per relocation. Any damage incurred during shifting will be recovered from the member

f.     Members/tenant should compulsorily submit the “Tenant Information Sheet” at the Rabodi  Police Station within three days of the tenant shifting in and hand over a copy of the same to the Society’s office

g.    In case of leasing / leave and license agreement involving foreign nationals, relevant police requirements / approvals / registrations should be obtained and copies furnished to the Society at the time of application.

h.     All leave and license agreements have to be compulsorily registered by the member and a copy of the same has to be furnished to the Society.

i.      Compliance with any other Government provisions / laws must be adhered to and the responsibility for this lies with the members. The Society reserves the right to meet prospective lessees before giving permission. Such permission could be denied at the discretion of the Managing Committee.

j.      Members are requested to adequately instruct tenants / licensees, about the rules & regulations of the Society, procedure for collecting their vehicle labels, etc. before they shift and request them to maintain cordial relations with everyone in the Society;

k.     In case a tenant/lessee is moving out of the building, concerned Member or his tenant should give at least 30 days notice to the Society in writing;

l.      Vacating tenant or the Member should clear all dues (water, electricity, etc.), obtain a No-Dues-Certificate and collect the Gate-Pass from the Society office before leaving

m.   Any damage to the property of the society will be the responsibility of the owner;
 
12.        Handling of Pets - In order to maintain a clean and safe community, we ask our residents and visitors to comply with the following rules:

a.     Please ensure the Pets are vaccinated in accordance with their medical schedule.

b.    When out of the flat, Pets must always be on a leash, except when inside the area designated for the Pets. Pet owners are requested to control the pets from getting too close to other residents unless the other residents desire to pat or play with the animals. Kindly keep Pets away from unaccompanied small children and very senior citizens.

c.     Pet owners are requested to ensure that their Pets always wear an identification collar/tag, with the contact address/phone number of the owner prominently mentioned on the tag.

d.    Pets shall be ordinarily taken into/out of the building through the  elevator unless accompanied by the owner themselves. In the latter case the owner shall confirm with the other occupants of the lift if they are comfortable with the pet travelling in the lift at the same time. In either case, the pet should be on a leash. In case of pets defecating the elevator, a penalty of Rs. 500 will be imposed on pet owner, if it is not immediately cleaned by pet escort.

e.    The pet owners will ensure that the Saket CHS premises are not littered in any manner by their pets. For Poo and Pee the Pets may be taken out of the Main Gate or to the designated area. The escorts shall be responsible for cleaning up and disposing pet waste in an appropriate manner and hence must always carry cleaning material like plastic and/or paper containers.

f.     In case of any breach of the rules b,c,d e, a fine of Rs 500/- will be imposed for every instance.

13.        Rules regarding sale of flat / transfer of flat a.     No flat, or a part thereof, can be transferred, assigned or sold without prior permission in writing of the Managing Committee of the society;

b.    Members desirous of selling their flats should ensure that they negotiate only with those individuals, who are eligible to become Members of our Society as per our Bye-laws;

c.     Members should apply in writing about their intention to sell and seek a “No Objection” letter from the Society;

d.    Society will, within 15 days of receipt of this request, issue a letter conveying its no-objection, stipulating all the conditions, prescribed under the Bye-laws of the Co-operative Housing Society Limited;

e.     The member or the transferee shall be liable to pay applicable transfer fee as determined by the Society from time to time

14.        Closing main gates at night: 

With a view to checking undesirable elements entering the society’s premises at night, the main entrance gates shall be closed between the hours 10.00 p.m. to 6.00 a.m. Members should use the duct gates at this time.
15.        Avoidance of Noise pollution: Musical instruments should be played in the flats at a reasonably low volume, so as not to cause disturbance or annoyance to neighbors.  Blaring use of T.V., Radio or any musical instrument as well as unnecessary blowing of car horn should be avoided.  Servants and drivers should also be instructed to abide by this rule strictly.

Security guards are empowered to intervene in case of noise above acceptable level.

16.        Spitting: Spitting, particularly of pan-juice, by residents or their servants in lobbies, landings, stairways, lift walls, lift carriages, foyers or any other places in the building premises or outer walls is strictly prohibited. A fine of Rs. 500 shall be recoverable immediately by the violator.

18.        Dealing with Hawkers / Agents / Vendors / Sales representatives a.     Society will discourage hawkers, door to door agents and vendors;

b.    If any sales representatives visit our premises, members may meet them at the ground floor lobby, exclusively provided in this behalf;

c.     No sales representatives shall be permitted to visit the members inside the flats unless the concerned member informs the Security guards stationed at the main entrance gate;

d.    Only approved vendors by the Society will be allowed to enter inside the flats;

19.    Miscellaneous

a.     All payments to the Society made only by Cheque in favour of “Saket Cooperative Housing Society Limited”. Sundry fines can be paid in cash, for which receipt shall be issued by society office.

b.    Members shall get receipts of all the payments made by them within 7 days of the cheque being realized;

c.     Members may note that monthly maintenance charges are payable, even if the flat is vacant. [In such cases of vacant flat, if the monthly maintenance is not paid by 10th of each month, appropriate penalty will be levied.]

d.    Members/residents may note that a penalty will be levied in case his/her cheque bounces back/is returned unpaid by the Bank, for any reason whatsoever attributable to him/her. [In case the cheque of any Member/resident gets repeatedly returned back on presentation by the Bank, the Managing Committee is empowered to initiate such action as it deems fit, in addition to the levy of the penalty];

e.     For convenience of Members/tenants, cheques/written complaint, etc. could be dropped through the slot provided in the drop box of the Society office, even after office hours;

f.     Society will celebrate Independence Day, Republic Day, Holi, Ganpati, Navratri and Diwali  and shall spend money for such celebrations which would be decided by the Managing Committee;

g.    Members/residents may note that if they collectively wish to celebrate any function to commemorate festivals like Christmas, New Year, Lohri, Id etc., then the Managing Committee needs to be informed at least 5   days in advance to facilitate such gatherings. Financing from such functions shall come from the contribution of interested members. As a token of good-will, the use of electricity/water for conduct of such community gatherings, may be permitted.

h.     Members/residents may please note that such social gatherings shall be strictly confined only to the Members/residents of the Society and must be carried out only with prior approval of the Managing Committee;

i.      Members/residents should not use the services of Society staff for any personal work. The staff  have been strictly advised to refrain from performing personal work of any Member/resident; if any of them are found performing such personal chores during office hours, it shall be treated as dereliction of duty, and such staff may be removed from service;

j.      Members/residents are requested to immediately inform the Security Guard/Supervisor  if they find anyone moving in suspicious circumstances or notice anything alarming/ objectionable;

k.     Members/tenants are requested to deal with the staff members and service providers courteously;

l.       Members/tenants are requested to immediately report to the Managing Committee in case they find any of the staff employed by the Society or the Service Providers misbehaving or not performing their duties/functions properly to the MC.

m.   Members/residents are strictly prohibited from entering the electrical Meter Room without permission. Violation of this will be viewed seriously and the Managing Committee reserves the right to charge a penalty and also will recover the charge for any damages to the property of the society from such erring member/tenant. Further the society will not be responsible for any accident to the member/tenant, if he enters without permission.

n.     In the best interest of all members, they are requested to furnish their “member’s data sheet” in the specified format available in the society’s office and also update the same immediately whenever any change occurs to the data furnished earlier. Members shall be solely responsible for all consequences for its non-compliance.

o.    For all violations / breaches / non-adherence to any of the rules / regulations / guidelines / defaults as stated above, the Society shall impose a minimum fine amount of Rs. 500/- for each of the categories mentioned above, which may be changed at the sole discretion of the Society;

p.    Member/tenant can also communicate their suggestions and views through the e-mail ID of the Society.

20.        Committee and Meetings a.     The Society shall call an Annual General Meeting within a period of three months after the date fixed for completing or drawing up of its accounts for the year. At least 14 days clear notice shall be given to members.

b.    At every Annual General meeting, the Managing Committee shall lay a statement of Income and Expenditure Account, Balance Sheet, a Report by the Managing Committee regarding the Society’s affairs.

c.     A Special General Meeting can be called by the Chairman of the Society or by majority of the members of the Managing Committee. Members too can requisition for such a meeting if 1/5th of the total members of the Society endorse this requisition. At least 5 days clear notice to be given to members

d.    A meeting will be held only if the quorum is achieved. For a General Body meeting, the quorum shall be 1/6th of the total no. of members of the Society or 20, whichever is less. Holding of adjourned meeting will not require quorum. However, as responsible members of the society each member should make it a point to attend all meetings as per the scheduled time to arrive at a democratic decision

e.     The decision taken in the general body meeting by the members present will be binding on all members.

f.     The final authority of the Society vests in the General Body of the Society comprising of all the members. The Managing Committee will be appointed for a five year term by the society members in the general body meeting and they will be in charge of managing the day to day affairs of the society. The Managing Committee will be responsible for maintaining registers, books of accounts and all documents pertaining to day to day affairs of the society.

g.    It is the duty of the Managing Committee to arrange for holding of elections of its members before the expiry of its term.

h.     Management of the Society vests in a duly constituted Managing Committee. The details of the Managing Committee will be registered with the Registrar of societies in the prescribed format.

i.      Office bearers of a Society can be removed by the way of No confidence motion. Such a no confidence motion has to be supported by at least one-third of the members of the managing Committee. Removal from office is effected only after the resolution is passed by a simple majority in the Managing Committee.

j.      "members of the Managing Committee shall meet as often as possible but at least once in a month"

21.       Pending Dues and Escalations

a.     All dues arising out of the application of above rules will be levied on the member as part of the maintenance bill. This levy will be payable along with the normal maintenance charges and all norms relating to charging of interest, etc will be applicable.

b.    Outstanding dues of members beyond three months will be displayed on the notice board.

c.     Details of members violating rules will be placed in the general body meeting and appropriate action, in accordance with Society Bye-laws, will be decided and taken.

This Charter is inclusive and not exhaustive. The Managing Committee is empowered to amend/add/delete any of the above clauses, if it is felt or intended to serve the general/overall interest of Members/residents and of the Society.

Annexure 1
Minors Repairs

1.    Minor repairs typically mean the maintenance and upkeep of existing furniture, fixtures, appliances, durables, furnishings, flooring and aesthetic features in a flat.  Illustrative examples include:

a.    Plumbing – Stoppage of leaks, replacement/installation of taps  fixtures and parts

b.    Electrical – Replacement of fuses, installation of fixtures, repair of appliances, lighting fixtures, switches and wiring

c.    Furniture – Repair of existing furniture /woodwork including re-polishing

d.    Painting – Touch up of existing paint on walls, ceiling or furniture /appliances

e.    Furnishing – Installation and repair curtain rods, blinds and netting

f.     Floors – Cleaning and polishing of existing tiles and repair of small cracks/blemishes

2.    The time required for such minor repairs will not normally exceed  2 days at a stretch

3.    Any repair job that is likely to take 5 or more days will not be treated as a minor repair and shall require prior approval

I propose to sub-let/give on leave and licence/care-taker basis my flat/part of the flat to the person named hereinafter under an agreement (copy enclosed) under the following circumstances:

(i) I am required to go out of the area of operation of the society under conditions of service / on business proposition / my prolonged illness. The duration of my absence from the headquarters will not be less than ………………………..years ……………………….months. I cannot continue in occupation of my flat during the period of my absence from the headquarters.

(ii) There are no facilities available at the moment in the locality of the society for education of my children. According to the information gathered by me, the provisions of facilities for education of my children may require …………………years/months. In the absence of these facilities, it will not be possible for me to occupy that flat/continue in occupation of the flat during the above period.

(iii) I could not secure admission to the school for my children in the locality of the society. It may take ……………………….months for me to secure admission to the school in the locality for my children. During this period, it will not be possible for me to occupy the flat/continue in occupation of the flat.

Note: State any reason other than those mentioned above to justify your Inability to occupy or continue in                              occupation of the flat.

I undertake to initiate legal proceedings against the sub-lettee/licensee/ care-taker on my failure to secure vacant and peaceful possession of the flat from the sub-Iettee/licensee/care-taker on expiry of the original or extended period of sub-letting/licence/care-taking and to make the society the party to the proceedings and to reimburse the expenditure which the society may be required to incur on legal proceedings to get back the possession of the flat/part of the flat.

I also undertake to pay all the charges of the society, including Non Occupancy Charges and Non occupancy Club Charges every month / quarter  within the time stipulated without any excuse from the date I part with the possession of the flat / part of the flat till I get possession thereof.
