Yet Another attempt at land grabbing by Rustomjee Builders near Saket

Dear Sir,
This has reference to the aforesaid subject. We want to point out to you the following:
1) There was a huge strip of land opposite to building nos. A7 to A 10, the status of whom is disputed.
2) 6/7 years earlier, the land was rotting with people from the complex throwing garbage and using it to dump construction debris'.
3) A portion of the land (photographs which are attached), was encroached by Zopadpatti's.
4) In the year 2010, when Mr. RA Rajeev was the Municipal Commissioner, we approached him through our then Corporator and Standing Committee Chairman Mr. Milind Patankar to clear the land of all the garbage and build 2 gardens there.
5) Accordingly, the Corporation built a Nana Nani Park and a Children's Park in the area thus beautifying it. The Children's Park was inaugurated by Mr. Rajeev.
6) Later the encroachment on the balance land was removed and Mr. Rajeev promised to build a botanical garden in that area.
7) However, after the transfer of Mr Rajeev, the matter fell into cold storage and that portion of land started rotting again.
8) We again approached the Corporation thru our current Corporator Mr. Suhas Desai, that if not a garden, at least construct a parking lot over there as parking is a big issue with our complex. The matter is still pending decision.
9) In between Rustomjee Builders who is building a township in the adjoining locality tried to grab this land and construct a Overhead Water Tank over there. It was after our ALMs protests and supported by Milind Patankar and Suhas Desai that they backed off.
10) Since the past 3 days we are seeing a JCB coming and cleaning the area. We thought that the Corporation is cleaning out post monsoon and were pleasantly surprised. But on checking with the Ward Council, we were told that the Corporation is not doing it.
11) Today when the JCB appeared again, we took photographs (attached) and questioned him as to who gave him the instructions to clear the area. He said Rustomjee Builders.
Sir, this is the second attempt by Rustomjee Builders to grab the piece of land. Already, he has grabbed land which leads to a MSEDC sub station in our area by putting up his gates over there.
We request you to look into the matter urgently and stop the land grabbing immediately.
This piece of land does not belong to Rustomjee Builders and our ALM will use all possible ways and means to stop him from doing so.
You immediate action is requested.

Dear Sir,
I am writing this letter to complaint once again about yet another attempt by Rustomjee builders to grab the piece of land opposite to Saket Complex.
Today, myself and our Corporator Shri Suhas Desai have thwarted his attempt - but they will come again.
The person from Rustomjee builders showed us an approved plan given by TMC to them bearing no. 1299/14 and 505/0022/10 dated 9/12/2014 to build an unspecified thing over there.
I am enclosing the requisite photographs for your perusal.
Actually, the builder claims that the portion of land belongs to him and also showed us an extract from the Tehsildar office, again dater 12/2014.
This is absolutely bogus as the entire stretch of land from Mahalaxmi Temple to the turning towards the highway was one piece of land. TMC has constructed the Nana Nani Park and Children's Park on 70% of the land. This balance 30% was left out as their were Zopadpatti encroachment on the same when the 2 parks were constructed.
Rustomjee has been eyeing this piece of land for last 5 years. They initially wanted to construct a water reservoir over there, then a skating ring.
We have thwarted those attempts. Now, he has started all over again.
In fact, we have already made an application 2 years ago to TMC to build a Parking Plaza on this land.
We are reproducing the last 2 letters written by us to you in this regard and request you to please intervene and thwart Rustomjee's attempts once for all by utilising this space for good of the people in the area - say a Market place.

With reference to the above, we have to state as under:
1) There was a huge tract of land opposite to Saket Complex building nos. A7 to A10 and upto the junction leading to the highway and adjoining the MJP pipeline which was lying vacant and was rotting as residents used to dump garbage on that land.
There was also zopadpatti encroachment on the area opposite to where the newly constructed Fire Station is located.
2) We at SAKET PARISAR ALM were trying to find out who is the owner of the land but could not locate anyone.
3) As the land was rotting and the garbage and filth dumped was causing health hazards, we were approaching our then Corporator Milind Patankar to help us in the matter.
4) Mr. Milind Patankar, when he was the Standing Committee Chairman in 2010, had conducted a Survey of the land and later when Mr. RA Rajeev was the Municipal Commissioner, the TMC cleared the garbage and built two beautiful gardens - Nana Nani Park and Children's Park on that vacant plot.
5) Only the area where there was zopadpatti encroachment was left out at that time and Rajeev Sir had then announced that after the zopadpatti is cleared the TMC will build a Botanical garden in that area.
6) After that Mr. Rajeev was transferred and Mr. Patankar's constituency changed in the 2012 Election.
7) Though TMC did remove the zopadpatti encroachment from the land, since 2013, it has been lying vacant.
8) In the past 4 years, Rustomjee Builders who is building his township nearby has on 3 occasions tried to usurp this plot of land.
9) On all occasions, after my/ our ALM's complaint to TMC, he was thwarted from wresting the land. But he keeps on trying after every few months.
10) Now he has started building a compound wall - photos attached- and trying to swallow this plot again when it is not belonging to him.
11) In fact, our ALM's application to the TMC to construct a Pay and Park facility on this land is already pending approval from the Corporation. We are regularly following up with our Corporators in this regard.
12) We request you to please look into this matter and stop Rustomjee Builders from illegally trying to wrest the vacant plot of land by misreprentation of facts.
