Cost of Deemed Conveyance


The actual cost of getting deemed conveyance in Maharashtra typically ranges between Rs. 2,000 to Rs. 3,500 per flat, including advocate fees, depending on the number of flats in the housing society, with larger societies potentially having a lower per-flat cost; however, the exact cost can vary based on legal fees and specific circumstances. 

Key points to consider:

  • Application fee:
    A court fee stamp of around Rs. 2,000 is usually required to file the deemed conveyance application. 
  • Advocate fees:
    Legal fees for drafting documents and representing the society can significantly contribute to the overall cost, varying based on the complexity of the case and the lawyer's charges. 
  • Number of flats:
    The cost per flat can decrease as the number of flats in the society increases.

• 10 to 25 Flats – Rs.3,500/-per flat + Rs.25,000/- (Advocate Fee)

• 26 to 50 Flats – Rs.3,500/-per flat.

• 51 to 100 Flats – Rs.3,000/-per flat.

• 101 to 200 Flats – Rs.2,500/-per flat.

• Above 200 Flats – Rs.2,000/-per flat.



Sub: Deemed Conveyance 

1) The scheme of Deemed Conveyance was brought by the state govt. 
in 2010 because more than 80% of societies in the state were suffering 
as builders refused to convey land and property to the society.

2) *Deemed Conveyance scheme is basically to give Conveyance to societies 
and all societies will get DC if all their documents are in order. 
So don't worry as to what will happen to Saket DC - you will get it.*

3) Societies have to make their application to the DDR 
with a fee of Rs. 2000/= (for one society - i. e. 
Entire Saket will pay ₹ 2000/- with the application.)

4) Once the application is submitted to the authorities they issue 
Deemed Conveyance Scrutiny Report- Form VIII within 1 month.

5) Once the compliance is provided the authorities issues 
Summons & Newspaper Notices to the Land Owners & Property Developers for appearing for the hearing.

6) *During the hearing process authorities take into 
consideration the arguments of the both parties. The process takes place within 3-4 months. Once all the arguments are documented the office issues a Deemed Conveyance order within 1 month*.The whole process is completed within 6 months as this is a time bound activity.

*Saket position*

A) *Though nobody has told me anything about the matter, 
by my experience, as I am from the same line - I presume 
that Saket must have finished upto this step*.

B) Next stage is Registration.

*REGISTRATION OF DEEMED CONVEYANCE*

1) On receipt of the Deemed Conveyance Order, 
the Deemed Conveyance between the Competent Authority & 
the Society is prepared. 

2) The Competent Authority appears in the Deed on behalf of the 
defaulting Land Owners & Property Developers.

3) The Deemed Conveyance is submitted to the 
Office of Competent Authority for Approval & their Signature with 
Authority Stamp & Seal.

4) The Special General Body of the Society is called to approve the 
Deemed Conveyance & to nominate 3 Members of the Society to sign 
the instruments.

5) The Deemed Conveyance is executed by the signature of the 
Competent Authority & the signatures of the 3 nominated Members of the Society.

6) On execution of the Deemed Conveyance, it is forwarded to the 
District Stamp Office for Adjudication. 

7) If all the Members of the Society have paid the Stamp Duty on 
their respective Flat/ Shop Agreements & there is no balance FSI, the 
Deemed Conveyance attracts only Rs. 100/- Stamp Duty. 
The Stamp Office issues the Adjudication Certificate.

8) On receipt of the Adjudication Certificate, the 
Society pays the required Stamp Duty & gets the Deemed Conveyance 
Franked from local Bank.

9) After Franking of the Deemed Conveyance, the same is 
submitted to the Registration Office for Registration. 
The Registration Office issues a notice to the Land Owners & 
Property Developers to verify whether they have received any Stay Order 
from Proper Court against the Deemed Conveyance Order.

10) The Proper Court for issuing the Stay Order against the Deemed Conveyance 
Order is High Court. It is very difficult for the Land Owners & Property Developers 
to obtain the Stay Order from High Court against the Deemed Conveyance Order.

11) If there is no Stay Order received, the Registration Office Registers the 
Deemed Conveyance. 

12) The Competent Authority is exempted from appearing for the Registration 
& hence the 3 Members nominated by the Society only appear for Registration.

13) After Registration of the Deemed Conveyance, the Registration Office issues the 
Scanned Document & Index II typically within 15 days.

14) The complete Procedure of Registration of Deemed Conveyance is typically 
completed within 3- 4 Months. On receipt of the Index II, the Registration Process of 
the Deemed Conveyance is successfully completed & the Society becomes the owner of the Land & Structure.

*Members, this is the exact procedure. Hope eveyone now has clarity as to what will happen when. 
But be assured that Saket will get DC because the DC scheme has been devised to favour societies and give them Conveyance which is their right*.
