Non submission of 'O' form and Audit Rectification Report by Saket CHSL Thane West since past 3 years.

January 24, 2018. The Dy. Registrar of Cooperative Societies, Thane City, Thane. Dear Sir, Sub: Non submission of 'O' form and Audit Rectification Report by Saket CHSL Thane West since past 3 years. ------------------------------ ------------------------------ --------------- This is to inform you that our society, Saket CHSL, Thane ( West) have not submitted their Audit Rectification Report in O form for the year 2017-18. Our AGM was held on September 30, 2017. The Auditor had given the Society his Audit Report with scathing remarks and a Special Report on September 21, 2017. So, the Society was duty bound to upload its Audit Rectification Report latest by December 21, 2017. The Society Management has failed to do so. In fact, as of today, they have still not finalized the ARR nor informed the Managing Committee about the same. For your information, Saket Managing Committee have not filed the ARR and O form for the past 3 years. I request

DATE: 27/2 /2018 SAKET CHS LTD, THANE DRAFT MINUTES OF THE AGM HELD ON 30 TH SEPTEMBER 2017 Due to lack of quorum at 10 am, the Chairman Mr. Hemant Hajare adjourned the AGM for half an hour and then reconvened it at 10.30 am. Before the Chairman could start the meeting, Mr. S D Jayawant raised a point of order. He stated that the meeting was invalid because as per byelaws, the Auditors Report have to be signed before the notice of the meeting is put up. Here, the Auditor’s Report was signed on September 21, 2017 while the AGM notice was put up on September 15, 2017. The Chairman overruled the objections and started the meeting. In the beginning, the members observed a minute silence in memory of those members who had departed from us since the last meeting and also those killed in the Elphinstone Road Station stampede. Open letter on Managing Committee working and Statutory-compliance's.

11/12/17 Dear Colleagues in the Managing Committee, I am writing this open letter with a great deal of anguish, anger and defiance. This year our Auditor has in his Audit Report passed such harsh structures on the Managing Committee working that it is a matter of shame for the Committee. This is the first time that such harsh remarks have been made by any Auditor in the 18 year history of the Society. For me, it is a tough pill to swallow that the remarks have been made when I am a member of this Managing Committee. I pride myself for my knowledge about the MCS Act and the byelaws. I give my advice to many Housing Societies - personally and online and my Sahakarsutra blog has been read my over 50,000 people. And this catastrophe had to happen in my Committee. I take it as my personal failure that my Committee people have "purposely and in a planned manner" not contacted or consulted me in the past 2 years.  I deeply apologize to all fellow

Cancellation of 38 parking slots.

14/12/17 The Secretary, Saket CHSL, Thane. Dear Sir, This has reference to our yesterday's Managing Committee meeting where in you showed members a list of 38 members who have not yet paid parking dues for the current year, 2017-18. It has been a policy of the Society that the parking dues are collected in advance from members. At most, we expect them to pay by the end of the first quarter April - June. In this case, it has been over 9 months that these members have not paid. In view of the above, as I had suggested in the meeting, you immediately cancel their parking slots and allot them to members in the waiting list. I putting this on record as yesterday, no decision was taken in this matter. Hope to see a prompt action in this regard. Regards, Dayanand Nene Member, Saket Managing Committee

Compliance of the byelaws

29/10/17 Dear Members of the Managing Committee, I have been writing to you at various times on various subjects pertaining to the Model byelaws and the MCS Act, with a view to inform/ educate/ create awareness of the same and emphasize the need to follow them. Sadly, most of the time, my advice has fallen on deaf ears and the committee in the past two years has broken the law many times with impunity. Though ignorance of law can't be a reason for breaking it, it can be sometimes condoned. What can't be condoned is if it is done purposely, inspite of knowledgeable members pointing out to you. And that is sadly what is happening in our society. Since May 2016, the office bearers have wilfully and purposely neglected me and my advice and have propelled the society on a downward spiral. The Special Report by our Auditor, is the first time in the history of the Society that such scathing remarks have been written about our society. What is more shameful is that

Society cannot charge or demand money / donation for the Cultural/Festival Expenses from their members/residents.

23/10/2017 Dear Saketians, Read the following carefully. It is going to have a impact on our society from now on. Post the 2014 amendments to the byelaws, Society cannot charge or demand money / donation for the Cultural/Festival Expenses from their members/residents.  The Society cannot implement such Resolution in AGM / SGM and put burden of contributing any money on all the members including the members who are not interested to participate, even though such Resolutions are passed. For Social, Cultural or Recreational activities; Society should use the Reserve Fund as described in Byelaw 147(b)iii, iv and utilise it as indicated in Byelaw 5(d).
