My rights as a Managing Committee member - in connection with the stupid behaviour of some Committee members.

The Chairman / Secretary, Saket CHSL, Thane. Dear Sirs, As per the MCS Act and model byelaws of the society, members of a cooperative housing society elect from amongst them, some people on the Managing Committee. The Managing Committee is collectively responsible to run the affairs of the society. All Managing Committee members have equal rights and responsibilities. Nobody is superior or inferior. For convenience, members of the Managing Committee elect from amongst themselves, 3 members to be the Chairman, Secretary and Treasurer of the society. These 3 people have additional powers than other members of the Managing Committee  - they have the right to sign cheques and other documents on behalf of society. Other posts in the MC are mostly decorative in nature and have no legal sanction. While the Thane Municipal Corporation (TMC) has warned police action against those who interfere with the vacation of dangerous buildings, a Thanekar says that one building which needs to be immediately vacated is the office of Deputy District Registrar of Cooperative Societies near Thane station road. He has taken up the matter with the PWD minister and other authorities. The deputy registrar's office at Vardavat mansion in Thane (west) is frequented by a lot people on a daily basis. There are over 10,000 societies in Thane and this is the office where they have to visit to get their queries addressed. However, this building has been declared as dangerous by the TMC. A notice announcing that the structure can fall any time has also been put up in the building. Minutes of the SGM held on 25th Feb 2018 for Repairs

SAKET CHS LTD. Thane Minutes of the SGM held on 25th Feb 2018 at Saket Club House at 10.30am to discuss the following agenda: 1. To read and approve the minutes of the last SGM 2. To discuss and approve modernisation/upgrade of lift 3. To discuss, finalise and approve the appointment of project consultant for undertaking and completing the entire repair project. The Chairman adjourned the meeting by 30 minutes due to lack of quorum. The meeting was then called to order at 11.00 am. The Chairman welcomed the members and requested members to rise and observe a minutes silence as a mark of condolence to the families of the departed souls of the complex. The Chairman / Secretary, Saket CHSL, Thane (W) 400601, Dear Sirs, I had written to you earlier and then you had also taken the following 2 subjects raised by me for discussion  in the last Managing Committee meeting. 1) Writing letters to Sanjay Tupe & Co. and Kaustubh & Co., asking them to return our society money for services not performed by them. 2) Calling an SGM to decide on the Parking Policy for the society. Letter written to you: 3) Decision being taken as to how to deal with the Rs. 35 lakhs profit shown in the Society accounts last year. Feedback of Otis Elevator - Misrepresentation of Contract terms

Feedback regarding Otis: I promise you I will never use this company again! After spending close to Rs.10,00,000.00 to retrofit a new Otis Elevator in a building we were presented with a service agreement. Or mistake was not taking the time to carefully read it. They assured us that they would change it. We took them at their word. They have an onerous service contract whereby you must wait 5 years for it to end. Then they give you a 30 day window to terminate the contract. If you forget or you don't it, the contract automatically renews for another 5 years! We were informed that the contract would be modified and of course it was not. There salesperson had selective memory concerning the representations made and denied making them. Maharashtra Government introduces the Maharashtra Lifts, Escalators and Moving Walks Act, 2017 The Government of Maharashtra (“Government”), vide notification dated 17th January, 2018, introduced the Maharashtra Lifts, Escalators and Moving Walks Act, 2017 (“New Act”), thereby, repealing the Maharashtra Lifts Act, 1939 (“Repealed Act”). The Government of Maharashtra will notify the date on which this Act will come into force.
